Terms of service
effective 1 October 2026
These terms cover your use of MarketSDK and marketsdk.com, both provided by Focussoft HQ LLC. By creating a workspace you agree to them.
The service
MarketSDK is software for running a marketplace. You run the marketplace. You are responsible for what is sold on it, for your own terms with your users, and for your refunds and disputes with them.
Your workspace
You are responsible for everyone you invite to your workspace and for keeping your API keys secret. Tell us at once if a key is exposed.
Acceptable use
You must follow the acceptable use policy. We may suspend a marketplace that breaks it. Suspension makes the marketplace read-only and deletes nothing.
Plans and payment
Paid plans are billed in advance, monthly or yearly. Use above your plan's allowance is billed at the end of each period. Prices exclude tax. If a payment fails we retry, and after 14 days the live marketplace becomes read-only until it is paid.
Stripe
Payments on your marketplace run on your own Stripe account, under your agreement with Stripe. Stripe's fees are between you and Stripe. We never hold your money or your users' money.
Cancelling
You can cancel at any time. Your plan runs to the end of the period you have paid for. After that the live marketplace becomes read-only, and your data is kept for 90 days.
Your data
Your data is yours. You can export it, and you can delete your workspace. We use it only to provide the service.
Changes to the service
A published version of the API does not break. A change that would break it ships as a new version, and the old one keeps working.
No warranty
The service is provided as is. We work to keep it available and correct, but we do not promise that it will never fail.
Limitation of liability
To the extent the law allows, our liability to you is limited to the amount you paid us in the twelve months before the claim.
Governing law
These terms are governed by the laws of the State of Wyoming, United States.
Changes to these terms
We may update these terms. We will email every member of your workspace before a change takes effect.
